2000 Trail Blazer problem

I have had my TB for about 5 months now. The first time I tightened the chain the bolt on the right side of the eccentric axle had to be tightened close to 3/8 inch more than the one on the left side to reach 60lbs of torque. I thought this was strange but chalked it up to the eccentric axle. The second time I tried taking the slack out of the chain this same bolt would not tighten to 60lbs and I noticed the fingers (for lack of a better word) just below the bolt head on the top part of the swingarm were spreading apart. This has not happened on the bottom fingers and has not happened on the left side or on a friends 250 or my Scrambler. I took it back to the dealer and he used a new bolt and some thick washers and torqued it to 60lbs. He didn't seem too concerned about it but now the fingers are less than a 32nd of an inch from hitting the sprocket. I've told him I wasn't happy with it and he said he will call Polaris and see what they can do.
It looks like the Heat treatment in that part of the swingarm is bad to me.
Anybody else experience this on any model?
