Disputes like this should be settled on the trails. We could start with a drag race and move on to a mud bog? Winner gets to have his position prevail!

For the Skok cops to make a deal with the local county procecutor to by pass the ruling is wrong. I know several of the other cops on the res including Brett's boss and they don't do this stuff. And just because a citizen mouths off is no reason to treat him different. He didn't write me for 10 over during on New Years Eve, so why write a ticket that's gonna create a stink? If the res cops have no right to write citizens on 101 they it really doesn't matter how fast he was going does it? This ticket stuff is a recent development that was covered before and the res of the res cops in the count don't do this. It's about abuse of power and I know several others that have complained about ticketing thing and the state says, just throw the ticket way.

HI Fred,
Well, I'd beg to differ on the fact that US vs Montana doesn't mean crap in this state. I believe it is a federal case. Case law does not have to be specific to a state. (genereally speaking anyway, and at least from what I've seen by watching Supreme Court cases).
How do you know the res cops in this state cannot write tickets to non-indians. Where is that in writing or law?
Where does it state they don't have the right to write tickets on Hwy 101.
I don't personally know if that is true or not, but doesn't make sense to me. So help educate me by showing me proof. The law, where in the treaty, anything in writing that states that they do not have the right to do it.
First, he didn't write you a ticket because he was on a DUI emphasis patrol, You weren't drinking, and you weren't a prik to him. So why waste time when he could get back out and look for the drunks that could kill or hurt somebody else?
What do you mean by "they don't do this stuff"?? They don't write tickets to non-natives???
ALL cops don't give everybody they pull over tickets.
Ask the State Patrol for their reason for not giving everybody a ticket they pull over. I can't remember there exact response, so I won't try to quote it, but basically it's officer discretion, and it's as much a informative/learning experience.. (their words, not mine)
So if it's officer discretion, they obviously have certain thing they will write people for and what they won't. It's pretty much common knowledge, that if you are a prik to a cop, he's gonna write ya. If you are nice, don't lie, sometimes that'll be enough for them to not write you. Or if you are Blonde, oh wait, never mind
NOW for Brett, he didn't write him the ticket because Mr. Sheldon was acting the way he was. He wrote him because he was on a emphasis patrol and EVERYBODY got a ticket. Do you actually really think Brett wrote him a ticket to try and make a stink???
I still don't understand, whether they are a tribe or not, why I should be able to go through THEIR land and break the law and not be held accountable. I can see where they obviously would have no juristiction outside of the reservation.
I don't claim to know all the Facts and official laws pertaining to this, I'm just stating my opinion on the circumstances of Mr.Sheldon getting a ticket, and the fact that from what I've looked at and read, I don't understand why I'm exempt from following the laws while traveling through any tribal reservation. As I said, I hope this will at least lead to a concrete answer so this issue can be resolved. (not sure if the tribal lawyer has the ***** to follow through though )
But don't think my brother did all this because "he can" or "abusing his power". That is far from the truth, and I'm sure he would more that take exception to that. He is not even close to being like, he is more than fair with everybody.
Thanks Freddy

Hopefully the tribal attorney will have the Kahunas to see this out ( I doubt it though) and maybe this will go the distance and finally get settled, no matter who wins

A change of attitude on your part might be in order.........
Brett was not screwing with him, so stop making it sound like that.
Brett was doing his job, and didn't even know who he was when he pulled him over. Until he started being a prik and acting like some important person that is above the law.
And to say that a law enforcement officer should not hold somebody accountable for their actions because of who they are is BS. Give me a break.
Brett does not play that game. He's more than fair with everybody he pulls over, and hardly gives out any tickets. He didn't give you a ticket when he pulled you over now did he....
In Sheldon's case he was on an emphasis patrol and everybody got tickets.
How bout Tim's relative that is a Judge that got a ticket the same day? Why did she pay her ticket?
Plus, its' not over yet. We'll see how it turns out in the end.
Doesn't matter how it turns out, as long as the thing gets sorted out in a "fair" way(like that's possible) and their is a clear cut answer......
2 points in that article that tell me what kind of person Mr. Sheldon is.
#1 - he says he got a ticket for doing 55 mph in a 45. hhhhhmmmmm. He was breaking the law and is now looking for a way to get out of it. What an upstanding citizen he is.
#2 - He says his the folks he represents have complained to him over this for a while now. So why is it that he is now giving a crap and wanting to do something about it? Is it because he now has got at icket and doesn't like it? What an upstanding politician he is.
By the way: Look up the case law for US vs. Montana. Don't remember all their funky lilttle numbers that go with it.
