After dropping the information bombs the other day, I wanted to follow-up with some new information. According to some sources close to the decisions about Pilchuck Forest and the North Fork Nooksack River area, these areas are being closed because of concerns about the state's liability from recent deaths. Apparently, there have been 3 deaths in the areas related to ORV use and the DNR is worried about being sued if there are any more serious accidents. The closure does not have to be permanent. Some legislators are working with DNR to get the areas reopened and to protect our riding areas elsewhere in the state.
I have two thoughts on this news. First, this is the same attitude that led to the closing of the Thurston County ORV area. I would rather the land manager spend greater effort in identifying trails and clearly marking them, then to run away from the problem. The Forest Service does a pretty good job of labeling its trails as easy, medium or difficult and providing descriptions of them. I suspect much of that work was done by volunteers. Such could be the case with state lands and riding areas. Clearly marked and well maintained trails keep unruly persons from going off trail to blaze new trails and protect the surrounding environment. The answer is to be more proactive not to curl up in a proverbial ball in the corner.
Second, it is part of a larger tort liability problem we have in this state. Unfounded lawsuits are filed and settled out of fear of larger jury awards. Some years back the state gave up its Constitutionally granted sovereign immunity from lawsuits. Now the state budgets millions of dollars a year for lawsuit settlements and awards. For at least 5 years a group working in Olympia under the umbrella of the Liability Reform Coalitioin (http://www.walrc.org/) has tried to pass comprehensive liabilitty reform. Included in that reform package was a limited reinstatement of state sovereign immunity. Sensible legal reforms would benefit us all.
On a side note, if you have not voted, please vote YES on I-330 and NO on I-336. I-330 is medical liablity reform produced by doctors, nurses, and business interests. I-336 was written by the trial lawyers. Passage of I-330 and defeat of I-336 will send a message to legislators that the public supports sensible liability reforms.

looking at the weather report reminds me prompt everyone to think about several things...
1. As Q4F had mentioned earlier, a PSAR Christmas Party, I prefer a Saturday afternoon/evening.
2. New Years at the Dunes... Horsfall. Would like to see who's interested. There was a discussion at Florence and there is some level of interest.
3. Winter ride at Moses in January... plan campin'/ridin' in the snow...
