They can stop and use their past experience to actually conduct the specified test SAE J-1287 to issue a violation, correct? Otherwise how could they stop you (it's a primary and not secondary offense right)?

Then, they conduct their test. They stop you based on their experience.

And if so, did they believe it was loud, based on their experience. If so, they can add that to the citation also. So, under this scenerio, yes, they can issue a second violation to the citation.

They use their judgement that it's too loud to stop you. THEN they have to perform the specified test. If you fail the test, you get the ticket.
I was trying to get at they shouldn't be able to just ticket you, or say you can't ride somewhere based only on their ear. I guess if the bike/quad is REALLY obnoxious (I've seen someone go over 104 dB on a WR400, WB E-Series w/4 plates) then I could see a Ranger telling them to not bother cause he'll be back with a meter, or will go get one from his truck. I'd doubt they would carry them around with them, UNLESS they are specifically doing sound enforcement. I know at Hollister they have 2 people conducting the test, well, I guess 3 if you include the rider sitting on the bike/quad:
1) Rider sits on bike in normal riding position.
2) One holds some kind of instrument, I'm assuming it's a tachometer of some kind on the seat and operates the throttle.
3) Other person holds the dB meter at the prescribed location, which off the top of my head is 20" away at a 45 degree angle to the outside of the centerline of the exhaust opening. Exhaust flow should NOT be directly towards the meter.

The Ranger at Wildomar was telling us our bike/quads were too loud based solely on the manufacturer of the pipes we all have. Our quads weren't even running yet. He said there's only one kind of FMF pipe that's acceptable other than stock. None of our toys are obnoxiously loud or even anywhere close to it, they just sound "nice", that's all. Heck, if I would have known this was going to be a huge problem I would have left my quad stock. It's just that in the entire 25 years I've been riding, I've NEVER had anyone EVER say a single thing about how loud anything I rode was. We go out all the time and nobody ever says anything. Our toys aren't loud at all compared to most others out there. I feel that if the Rangers want to do something about "noise" . . . how about banning all those inconsiderate people out there with those loud-*** construction generators irritating everyone at the campground and keeping us awake all night?? Now THAT'S annoying! I can understand about the bike noise IF the riding area is close to residential areas, but when you're out in the middle of nowhere, who cares? I feel the important thing is that we're considerate riders/campers. We don't litter, leave everything the way we found it, we're considerate of our camping neighbors (no loud music/partying/generators after a certain hour, etc.), we keep our dogs inside our RV at night so they're not keeping everyone awake barking like so many idiots do. What else can you ask for?

Wildamore Rangers are F-ing idiots. I stoped camping there about 5 years ago. The rangers show up in camp at 6pm to check the green stickers on all the bikes. Then at 10pm when the stupid kids from Elsinor come to party the Rangers are no where to be found. By morning the kids are gone and the Rangers come back and ask if all the garbage is from my group. They told me to call when the Kids come in. Well 10 years ago who had a cell phone. Yes this is a sore subject for me.

I hear ya . . . The last time we went there was around 4 years ago, and now I know why. It's like the Rangers can't wait for you to show up so they can swarm down on you like you're a bunch of criminals. I haven't been hassled that much even when riding in "illegal" places! We're never going back there, and everyone else around us said they're not coming back either. They hassled everyone. It's too bad because it's so close to where we live. There's lots of other places to go though - we'll just keep going to those.

In our parks, we didn't enforce the noise laws. Didn't have meters to read it. But, we really don't have a lot of complaints. Our parks are in the middle of no where[img]i/expressions/face-icon-small-smile.gif[/img]

If you want to make a difference where you ride, be pro active. Get their office number, call them while you are camping/riding, give them dates, times, number of riders, license plate numbers, their quads/motorcycle descriptions, of the problem riders. Maybe these idiots frequent the area and NEED SPECIAL ATTENTION[img]i/expressions/face-icon-small-smile.gif[/img]Then, maybe they(rangers) will adjust their schedule and do direct enforcement on your complaints. One of the things I've learned in my 18 years, I can't be everywhere[img]i/expressions/face-icon-small-sad.gif[/img] and see everything[img]i/expressions/face-icon-small-sad.gif[/img] But, I was more then willing, to adjust my schedule to stop the problem riders from making everyones riding places from going to he!!. Majority of us are riders ourselve[img]i/expressions/face-icon-small-smile.gif[/img] Also, if the rangers are not working, find out who does the enforcement? Chances are it's the county sheriff, call them and make your complaint. They should send a deputy unless, they do not have jurisdiction on the property. Especially if it's federal land. Just ask. Enough complaints might get the sheriiff's office, to get the rangers to adjust their schedule. MD

They've probably been looking at the Noise Testing Data. It's listed by manufactuer. You might have to look through the list. Sometimes a bike will be listed under it's Manuf. ID and sometimes under it's name. Like either Warrior or YFM350X. It shows which exhaust was on the bike.
There is more information at the Home Page of the OHMVR Division and on this Noise Regulations Page.
Sounds is becoming the next battle ground. I know that Hollister is very active. At about 10pm every night the Rangers come through and tell people to shut down the generators and keep the noise down. Last time I was at Pismo in July it was the same way. I seen them come over and turn off this passed out drunk guy's radio. They know that sound is going to be easy pickings for the opposing lawyers. "Parks doesn't even enforce their own rules!"
