Warranty? Probably a 30 day warranty on an unused item. If it's used, my guess is it's your problem. When you get it, just check for apparent defects, rips, make sure the filter attaches to the plate correct, the plate attaches to the air box correct, and you are set. The foam filter is tough and should take repeated washings. I have had mine a while now and it's a great product.
