KNOWSALOT, I pretty much said the same thing, but forgot to hit the reply button(Hey, I have the Flu right now so I'm not all here mentally, haha)but anyway, if people start b!tching about them getting hurt on Quads, say good-bye to our sport, if you don't remember, before quads there were Three-Wheelers, which alot of people don't know how to ride and got injured/killed on them so they/there families sued the Manufactuers(mainly Honda I believe). I think if you are going to do anything, just have all the people you can get to sign a Petition of some sort, set up a meeting with the people at Yamaha, and show them whats going on and that they should fix it, but stay out of court, otherwise the freakin Eco-**** stoners are gonna use this type of crap against us ATV'ers so they can have there way.

i agree with ltracerx just because you get hurt on a quad does not mean you should sue. I am just recovering from a acident, that left me with a broken right ankle, leg, and a broken left wrist,when my right foot sliped of the foot peg. I could have sued Yamaha saying that they knew this could happen and they should have put nerf bars, floor boards or something of that nature. But Anyway , that is beside the point, new quads WILL have problems in the first year or two of production notice that the banshee does not J-arms any more


IN OTHER WORDS DONT END THE FUN FOR THE REST OF US

I just started a debate class and we have been told to look at both sides of everything so i will give this a shot. You say they shouldnt sue (even after you get hurt on a defective product) just because of the fear that they might stop making fourwheelers? Well, It youll remember a while back with the firestone tires incidince did anyone say, dont sue, everyone might stop making tires. I dont see the point in that argument.

I know that i get hurt enough on my own and those bills sure have added up, so if a machine (that has been known to have problems) was not fixed because yamaha could not put there pride behind them, i would sue to atleast cover the cost of fixing the fourwheeler, and putting me back together also. Anyone disagree? tell me why

OK this is for the Firestone tires, everyone(almost) uses tires in daily life, on the other hand, a quad is just a luxury. So if someone did sue, there is a POSSIBILITY that it could mean the end of quads, although that will probably not happen. I do think Yamaha should fix all known problems, but keep it out of court. Now what, some idiot touched his exhaust after a full day of riding, and burned his hand so he is going to sue the Manufacturer's(don't take this serious, just the lady that sued McDonalds for burniing herself with coffee popped into my head?

Hey it happened once in the late 80's whos to say it wont happen again. I mean think about it, say that happened all over again, and we were all left with the choice of a rancher 350 4x2 or a rancher 350 4x4? What im saying is, what if the quad industry decided that high performance sport quads were too much of a liability, and quit making them all together. No more Raptor's, DS 650's, Z-400's, 400 ex's, Banshee's, Canondale's, and any i missed, it would suck. Not to say that we wouldn't still have the quad's we've got now, but when your 'shee wears out who wants to replace that with a Big Bear? Right now we've got choices when it comes to quads, lots of 'em.
Do I think that yamaha should fix this damn tranny problem, yes under warranty or not it is a problem and should be fixed. Recall? No not all 2001's are grenading, but i would think that up to 2006 they should fix all 2001's with this problem, if they want customer loyalty then they're going to need to stand behind their product,

Any one disagree?

A class action suit about a company having a known defective product and refusing to fix it, even under warranty...and you thin it would be the end of all sport quads as we know it? Wow, some of you people really have your head in the sand. A class action suit does not bring the company to its knees for billions of dollars. It just fixes a problem. This type of suit has been brought against many companies, and is usually settled to mean the least damage to the company. When GM was sued for the trucks exploding on side impact, they sent out a voucher good for a couple hundred bucks off of the purchase of a new truck (from them of course) and only to those who actually owned the trucks in question. So, worst case scenario, they had to reduce the price of ther $20k+ truck by maybe 1% and then they sold it!
Yamaha will not be sued for large cash sums... In my estimation it would be a suit that at worst case scenario has yamaha fix, at their expense, all the defective trannies up to a certain serial number that have the described problem.
To think that it would be the end of all sport quads as we know it, is utter ignorance.

One major difference that I've noticed between Holland and America is that Americans really like to sue. What do you think ended the production of the 250R/Lt 250/ LT 500? What do you think ended the ATC's? Who ever said to try to get a petition and have a lot of people sign it is a smart guy with the right idea. People get pissed off when a big company doesn't address their complaints, but those companies have a lot on their minds. If you get a bunch of people to sign a petition or right them letters or call Yamaha, then you would get their attention. Use law suits as a LAST RESORT!!

Couple of thoughts:

The class action against 3 wheelers was safety oriented and stated that the 3 wheel design was flawed - as safety hazzard. They were right and the 4-wheeler was born.

A class action against a transmission will not kill all ATVs. But could kill the original 2001 transmission design, which would not be a loss.

Other ATVs realize they have problems and fix them. Just take a look at Cannondale. They've found several design problems and replaced the existing part on bikes without question.

If a low percentage of bikes have a problem and there is no safety issue, then they really don't have a legal obligation nor monitary reason to admitt a problem. A recall on a part that is not failing on the majority of Raptors would be foolish. A recall would allow 100% of the 2001 raptors to have transmissions replaced. Better to have a couple hundred upset customers than millions of dollars in replacement parts/labor.

I had two Polaris recalled, A 325 Trailboss had connecting rod tolerance problems and our 425 EXP had a tranny problem. Theoretically. Neither actually had a problem, but Polaris recalled and rebuilt for free. No fuss no muss, just did it.
......So why is Yamaha being such a butt about this? They should just give every 2001 Raptor a 2002 tranny. Period. Some exec and some bean counter at American Yamaha are just trying to make the bottom line look good for the Emperor. They are being short sighted. They will lose far more being butts than simply admitting they made a mistake and fixing it.
......As far as a law suit, why not if that's what it takes. They have lots of insurance and lots of lawyers and lots of money, lots of our money. Simply as a matter of being a consumer they need to be held accountable. We have not had a problem with our Raptor tranny, but that doesn't mean we won't. And if we have one of the "good ones" does that mean that it won't go out till it's well out of warranty?
.......For what these babys cost they better not have glass transmissions. Yamaha needs to step up to the plate.
