JetMoto 110/125 nerf bar defect?

Anyone one know if the right side nerf bar is supposed to look this way? Looks like a defect to me, but want to compare to what others have before I call it a defect.
Also look at the way the plastic fenders align up on the machine.. huge gap on left side between fender and frame and the whole thing lock kind of like it is rotated clockwise.

Looks like it took a pretty good hit. Could have happened during shipping, but it shouldn't be like that.

The dent in the nerf bar is normal. I would suspect that the fender mount got bent a little during shipping. It should be pretty easy to bend the bracket so the fender is more aligned. If not call RaceWay.

I was trying to figure out why the heck this bend would be intentionally bent this way.
To me it seems that due to the way the engine sticks out on the left hand side, the plastics didn't fit square. In order to correct the clockward rotation of the plastics it would seem to me that the right nerf bar was bent intentionally in an attempt to counter this rotation but was not completely success. Any comments?
The only other photos I was able to find for comparison was at www.kidatvs.com of the 110 and 125. The first photo is of the 110. Notice how the left neft slopes downward, but the right takes an upward arc (due to the bend) and the plastic fenders is rotated clockwise like mine. I think I can even make out the bend in the right nerf bar in this photo. But it looks much more intentional manufactured this way then on my 110.

The second photo is of the 125. .. it is pretty obvious that the right nerf has an intentional bend. Again, notice the clockward rotation of the plastic fenders, although much less noticeable then on the 110. The 125 seems to do a much better job on controlling this rotation then the 110. The right fender is much more elevated by the nerf bar on the 125 then on the 110.

its comforting to know that my bike wasn't damaged during shipping..

well... I just got a response from JetMoto. I was wrong about the reason for the bend. The reason is that they use the same nerf bar for foot brake models. I am pretty impressed with JetMoto's customer support thus far. Got a response back about an hour after I sent the email. If they keep this up and I might have to buy another one. ;-)
