I would recommend that you do talk to a lawyer, but he is going to tell you the same thing, your out of luck unless you have something in writing that mentions a warranty. If no warranty is mentioned then you bought it as is!
No lawyer is going to take a case like that, however do go and talk to one as normally there first visit and consultation is no charge so you can save that money to start repairing your machine. Consider it a life lesson and be more thorough with your inspections next time. We have all been there and done that and just learned and moved on.

Unless you had any kind of warranty contract drawn up before you bought it, you bought it as is. Pretty sure any court is going to see this the same way.
At this point, you could get a lawyer, pay for him, pay the court costs and possibly pay any damages to the defendant if the wrong thing is said.
Take it to a shop and ask for an estimate to fix it. Decide who you would rather pay. Or start asking about how to fix it over in the Honda section. It may turn out to be something easy, it may be an engine rebuild.
Weigh all you options, ultimately this is your decision to make.

Never had it happen with an atv, once with an old GMC Jimmy about 15 years ago. Actually broke the transfer case while I was test driving it and tried to put it in 4x4. Guy blamed me for it and I ended up having to buy it anyway. I got it fixed and got rid of it a few months later at about a $1000 loss. The Grizzly 660 I had before I bought my Brute Force was a money pit too, it kinda soured me on buying from someone I didn't know. It wasn't junk from day one but I just finally had to get rid of it. It still needed work but I just didn't want to waste any more money on it.
