The dealer didnt say it isnt covered just that the warranty guys are sneaky and will try and get out of it.
I see no way that it shouldnt be covered so i just comes down to whether they want to fix my bike or refund my warranty.
Time will tell!
Thanks for everyones help!

Wait a sec...Its not at their option to fix your bike or refund you warranty price. WTF? You signed a contract. Hello?...A piece of paper saying that if certain things failed then they were to fix them. As long as its not caused by something you did. I find it hard to believe that they can get outta it. I call shenanigins on the dealer that you went to and are wasting your time with. Its a warranty take it to any dealer that you want to. Let them send out there "adjusters" and they will see that there is no way that you can ruin your transmission(for lack of technical knowledge) by doing simple bolt on modifications.

You are right
I am not saying I am giving them an option I am saying that if all said and done I have argued with them about it ect... and there not going to pay for it that I am going to cancel it. I don’t have time to get into a court battle over it.
I hope they fix it and all is well but I do know that some warranty companies will use any excuse.
anyways this is all going to take a couple weeks and I will update everyone with either good new or some lame excuse they gave.

You are right about the time element. i had a warranty through Western. It took them over 2 months to fix my Jet Ski. I know that if I was a customer that had a hand full of hundreds it would have been done in a few days. Its up to you what you want to do. I have almost completey decided on getting the refund on my warranty. I dont want to hear there lame *** excuses if something does happen. Also look at it this way. Undercutting of yours gears and cryogenic treatment is an up grade..Well at least that way you can justify the cost to yourself easier. Yeah I think your right about ditching the warranty, because there gonna do all they can to weasle their way outta it. It sucks it has to be this way. But then again there not still in buisiness because they like repairing quads. Kinda weird how the smallest reapair will cost you more then the warranty dont you think?

Stories like this make me glad about my dealer's service. I'm a good customer of my dealer and he is very nice plus I can get parts for just over dealer cost. That sucks your dealer is jerkin you around like this, I wish everyone had a dealer as nice as mine.

I would expect the blame to land on you (the rider). They will probably say you pushed too hard on the shifting leaver trying to jam it into gear and bent the fork.
I think Rotax started to see the issue with the quads because we tend to race these and when we shift into second we are jammin' it up there pretty good. When it was only the BMW F650 that used this engine they wouldn't see that kind of abuse.
Based on the above, I wouldn't expect warranty to cover it. . . it isn't a failure, it is damage as the result of heavy hard riding (hate to use the word but, abuse.) That really isn't a warranty item.
I am not trying to poke at you personally (heck, mine was bent too) I am just saying. . . I really don't see this as a warranty item and don't think we should beat up on the warranty company. An extended warranty is what it is (and in my opinion not worth anything for the Rotax motor.)

DuneMe,
I can see your point, I respectively disagree. These ATV's are sold on the sole basis of people riding them agressively, and event winning major races in their adds. the sales people will tell you how awesome the quad is,and how fast it is to get you to buy it. Everything on these machines are "abused". If these shops, and sales people are going to sale us the EXTENDED warranty, and tell us "its a good idea, incase something goes WRONG with the quad" but in fact it doesn't cover anything???
Anything that breaks on a quad can be argued that it was caused by abuse, But in this case,if they themselves have come out with an Improved part because of acknowledgment of a weak part. then doesn't this justify a warrantee item?? And if not what?
You would never hear of this "shifting fork" problem in a dirt bike, because the Manufacturer knows that those things take ABUSE! And they make sure that thier tranny's are Biult to last, cause if word of a weak tranny leaked out, their sales would definatley be affected. But these quads are NOT being biult with the same attitude as the Bikes IMO. And it is up to us consumers to make them take some responsibility.

One thing for sure, if they don't cover it the extended warranty isn't worth a dime.
I can live with what Bigger is saying (I'ld much rather see him right in this case!)
Didn't I see somewhere the DS comes with a 3-yr. warranty now (very recent ad!) Don't know why they wouldn't. . . there is nothing to go wrong with these quads that would cost them anything. I have had bent shift fork (now they have a newer design fork), broken chain roller (now they have a new design) and I think my tach took a crap on me (that is the only one that would be warranty (I actually bought a kit from the dealer for the Baja Tach since I don't have a Baja.)

I can agree with what Dunme and Bigger are saying. Yes they are gonna say that you abused the quad. There in buisiness to make money not give it away. But if you noticed it had a sticker on the quad that says something to the effect of not intended for use by riders under the age of 16 this is a "high performance" quad. Dont take no for a answer is all im saying.
