there is no law saying a 5 year old can't ride a 90cc its a manufacturer recommendation.

and why not just buy the Kymco 50/90cc to save cash. its the same machine.

The North Carolina Law does say about the minimum age limit on ATV. It's not just a manufacturer's recommendation. It is the Law - read below.

NC All Terrain Vehicle (ATV) Law

Updated 04-26-06

Senate Bill 189, which introduced safety regulations for the operation of all-terrain vehicles in North Carolina for the first time, was enacted during the 2005 session of the NC General Assembly and went into effect on December 1, 2005. According to Action For Children North Carolina, formerly known as the NC Child Advocacy Institute (NCCAI), Session Law 2005-282, the NC ATV law, includes an array of safety provisions, including:

> No child less than age 8 may operate an ATV.
> Children ages 8-11 may operate only ATVs with an engine displacement less than 70 cubic centimeters*.
> Effective October 1, 2006, every all-terrain operator born on or after January 1, 1990 must posses a safety certificate indicating successful completion of an ATV safety course sponsored or approved by the All-Terrain Safety Institute.
> Any violation of the provisions of the law is an infraction subject to a fine of not more than $200

This kind of minimum age law for ATV exists in many other states, not just in NC. Also, in addition to the minimum age, some states even require a training certificate for minors ,like in NC and California.

ah well thanks for informing me. it use to be just anything over 250cc you had to be 16 correct?

And if he is injured so will the state. I have already purchased the KFX50 and was able to get it at a better price that the Kymco. I rode it and it has ample power for my son. Thanks for all the input on this, I plan to get a larger versios for me and the wife in the spring! Ride On!!!!!
