I have read with great interest, about the campaign to ban production of ATVs'. After reading as much as I can stand of it, I felt that I had to write this letter.

You, Sir, are the very worst that this society has to offer. People like you will stop at nothing when it comes to taking the things that we enjoy, only for the purpose of lining your pockets, at the expense of the people that have been injured doing something that they CHOSE to do. What's next ? Jogging ? I don't know the stats, but I'm sure that more people die jogging, than riding four wheel off road vehicles.

The web page shows 3 wheel ORV stats, and pictures. Why wont you be honest with the people and tell them that these vehicles are no longer in production ?

Your bio states that you are a specialist in "consumer law". Doesn't this mean that you file class action suites against large corporations, settle for several million dollars, divide two thirds of that up among the millions of consumers, giving them $7.00 and you keep 1 third for yourself ?

How many pages of attorney listings are there in the Yellow Pages,in the area of the country that you do business? Even in the medium sized city that I live, there are 45 pages of listings for attorneys. Maybe the standards of law school graduation should be raised. Too many attorneys is why we have the Civil Liberties Union. You simply must find something to do, so you defend those who do not deserve defending.

Please do yourself, and society a favor. Take down the shingle in front of your office, and go get a job as a police officer, firefighter, or a truck driver. All of which are far more noble a profession.

I read this earlier. This is one of the most stupid things I have heard. This is right up there with people sueing Big Tabacco because they got lung cancer. How stupid is that. They choose to do something, get hurt, and decide to sue??? That is stupid. No one put a gun to their head.

Here's what I sent.

Dear Mr. Bennett & P.A.P.A.,

I am an avid atv'er. I ride because I choose to. If I crash it's my fault for riding wrongly. Not the manufacturer's fault for building it. I don't think banning the production of atv's is the answer to people getting hurt. Education, such as mandatory safety training would be a better answer. Why take away a great sport that is obviously loved by so many people? Did an atv'er **** you off? Did somebody make an atv trail a little too close to your favorite fishing hole? If it's truly a safety issue, are you going to try to get the production of cars banned next? Oh wait, you're probably one of those folks that are against me having my Jeep. Better known to you people as the dreaded "SUV". Are you also one of those people who complain about SUV's being gas hogs and taking up parking spaces, while driving a Lincoln Towncar yourself? Why don't you direct some of that energy toward something like illiteracy or the homeless. Those people need your help bettering their lives more than we, the atving population, need your help ruining our great sport. If you have something against atv's, don't ride them. Stay in your cushy office in the concrete jungle and off the trials. Please leave the destiny of our sport in our hands, thank you.

Help!!! I just got a nasty paper cut! I was planning to write a letter to Bennett Law when this happened. It HAS to be their fault, as I never would have gone near the pile of razorlike leaflets had it not been to write them about the law suit. Struck down right in the prime of life. I wonder what my compensation should be, 5 or 10 million. Good thing it isn't on my throttle thumb, or I would need much more for mental anguish of not being able to ride.

Seriously, though, these things DO hurt for how tiny they are. Don't say I never made a sacrifice for the atv industry.
Lawsuits like these are stupid. If they win, I just may go ahead with my suit. Now all I need are some sweet-looking starving kids to display to the judge.
Sorry to rant, but lawyers like these are ANOTHER of my sore spots.

Did you hear the news about the bus load of lawyers going to a convention and the bus lost control and plunged off a bridge into a lake? the driver got out unhurt, but all of the lawyers perished. The bad news is there was an EMPTY SEAT on the bus!!!! When the divers went to retrieve the carcass', the crabs and bottom feeding fish hadn't touched the lawyers, everyone realized that it was out of "professional courtesy". BTW the divers weren't volunteers, and had to be paid for diving in contaminated water...

I don't know how these guys find out what my hobbies are. I am an avid pistol, rifle, bow shooter, wild about four wheelers and the great out of doors. These "people" would like to save us from everything. I am scared to death they are going to find about food products and we won't be able to eat.

Here is how Mr. Bennett replied to me:

All major ATV manufacturers banned 3-wheeled ATVS by recalling them from the dealers but left over one million out in the public domain to kill and maime innocent victims. We have a case in Murray, Kentucky where the Yamaha Timberwolf steering column snapped due to a manufacturing problem. Kiwasaki just recalled 40,000 ATVs because of a belt problem. People make mistakes but manufacturers do also and the law considers the manufacturer to be the expert in making a safe product. Thanks for the letter and thoughts. Please keep my address when you are on the next AirFlorida flight that has oxygne cannisters aboard or riding on you Firestone tires.

Here is how I replied back to him:

Glad you answered all of my questions. Did you deliberately dodge them, or just forget? As for the steering column snapping, what about manufacturing defects in cars? Maybe you should seriously consider trying to ban them. What about the Ford pinto? Why don't you create, PAFP? (people against Ford Pintos) Isn't it just herendous that Ford discontinued that model which tends to explode and left them out "in the public domain to kill and maime innocent victims." Your petty law firm is a joke; you will never ban ATV's but I don't mind if you continue to waste your time. Obviously you don't have anything better to do. You are the type of person that gives lawyers a bad name. Either way, I'll be sure to remember your address next time I spill coffee on my lap and burn myself. I'll be a victim of McDonalds' faulty coffee cups. "Shoot, I thought if I dumped the cup upside down the coffee wouldn't spill out!"

i sent a nice note to them and this is what i got back


next time you ride on a Firestone or get on a Valujet plane with oxygen
containers in the luggage compartment, think about who you would call

and this what i replied with,ill keep emailing him,why not

well now i know it wont be you..first off if i ride on a firsestone and crash or get killed in a plane crash like valu jet i would have to say both cases have the parties involved that were negligent..how do you figure the manufacturers of atv`s are negligent? they clearly tag the atv with numerous safety warnings,heck half the owners manual is on how to operate it safely(the first half)..they also offer training course before you can take it home..my dealer wouldnt sell an atv to someone unless they were the proper age to ride,case in point he wouldnt sell me the quad i wanted for my daughter because it was too large of a machine..all i can say is if there negligent in someway because they have a defective part that may cause the atv to crash then they should be held accountable..what your saying is there negligent for manufacturing them when its clearly the operators inability to judge the machine or their own capabilities is when they get hurt..think of all the vehicles,auto,truck,farm equipment and so on..in your opinion you must have to say then all these machines should be banned as well as they can cause personal injury if not properly operated so come on,back off,find something more creative to make everyones insurance premiums cost more and waste our tax money taking up court time..im sure there are alot of people more needy of your services..good luck keeping up with the email as i know alot of people are not happy with your practices

Can I assume that you will be mounting an effort to stop production of ALL consumer you think are not "safe"? ATVs don't kill and maime riders, riders kill and maime themselves. All that aside. This is not about consumer safety, this is about money. Some fools were using an ATV in a stupid or unsafe way and got hurt. Rather then taking responsibility for being foolish and living with the consequences, people think they can pass the buck, blame someone else, and get rich. Lawyers are here to facilitate that kind of irresponsibility, and make a buck while they are at it. So preaching to me about how "unsafe" you think ATVs are is a waste. Because you and I both know you could care less! Your in it for the money!
