If the head lights are turned on, then yes the tail light would be on.

This goes for all the SPs, not just the 500. Watch those boots! It is fairly easy to tear a boot and then ruin a CV joint because of dirt/mud getting inside. I am not sure if this applies to the 06s, but on my 02 SP500 the tail light is always on, even when the head lights are turned off.
