Brand new LT80 runs horribly! Choke up or down?

Default Brand new LT80 runs horribly! Choke up or down?

It does not idle, they took the baffle out of the muffler because they said it would run better, it stutters, and bogs....I'm wondering now if they left the choke on. We didn't have much time on them, I (z400)just rode with my son(lt80) once around the block, but it kept stalling, and would not rev up right all the time. Then they went to the storage garage, so I don't have it in front of me. I'm just trying to think of why it would run so crappy. It can't be as lame as it seemed.
So, which way does the choke go?

Up=choke on
Down=choke off

Yep, I remember looking at it, and it was down but still "choked" half the time you gave it gas.

Back to the dealer with it, let them fix it, it's brand new.

A jet is plugged.

The machine is straight out of the rusty crate. Could it be dirty from Suzuki? Please tell me that they are decent little machines(I was hoping more for kick azz). I almost regret buying tthis one. Right now my inexperienced 7y/o is thrilled by anything, but I'm worried about a few months down the road.

One other thing,

Ours came with exhaust AND intake restrictors, did they remove both, or just the exhaust restrictor?

I presumed both restrictors were removed.
