Default Wrecked Eiger - Need Advice

Hey Guys,

My father (73 years old) bought a new 2007 Eiger (Automatic) exactly one week ago. This morning while hunting in the woods the throttle stuck wide open and he wrecked. He was thrown off before he could hit the kill switch. The bike then hit a couple of trees and got beat-up pretty bad. Bent rim, brocken plastic, bent brushguard, and most likely out of alignment. (I have not seen it yet. There may be more problems.)

Unfortunately, I was not with him (I am in Ohio and he was down in West Virginia). He will be coming home later today. His brother and a few relatives helped him get it into his truck.

His nephew had a videocamera and taped the bike with the throttle stuck wide open (He did not tape the wreck).

What should we do? Has anyone been in this situation before? We would like to take the bike back to the dealer and simply swap it for a new one. We don't want his repaired. Does this sound reasonable? Should we raise heck and threaten to sue them for trying to kill my 73 year old father?

I really appreciate any help.

Thanks,

Ryan

Hey,

I just realized that I should clarified that I was joking about suing anyone for trying to kill my dad. Don't want anyone to think that I am a complete jerk. Just looking for advice on a situation that is very new to me.

Thanks,

Ryan

DO NOT take it back to the dealer! Don't even tell the dealer what happened, call a Lawyer and he will find an independent expert to look at the wrecked ATV and this expert will find out if anything was defective on that ATV causing the throttle to stick. If you take it to the dealer he may find something wrong, fix it and cover it up like nothing was wrong in the first place. I have experience with Suzuki Dealers they are the lowest form of life on earth, they lie and cheat don't trust them or believe anything they say.

a 73 year old had an eiger wide open in a forest? that is dangerous, 73 year old bones dont heal quick, and eigers are pretty fast, they will hit 50m in a field and my brother had the speedo needle quivering at 70mph cuz it couldnt go any further, but he had the wind and a downhill helping him, im glad he's ok, im scared for my dad when he's driving through the fields and he 2 wheels it when turning.

What kind of Eiger do you have...My speedo only goes to 60mph and it only goes 60mph (granted the error of the speedo, probley 55mph)

That's still to fast for an Eiger, the gearing wouldn't allow 70 unless it was disconnected from the motor. lol

My advice: Get your story figured out a little better before you talk to ANYONE.
