will a 400 ex shifter bolt onto the shiftshaft without bending, or does it need to be bent to clear the stator cover?

I'm fairly certain that most any shifter you get will need bent to clear.

Look at this:

is that a warrior shifter with a clamp welded on? i got a 400ex shifter for free today, so i will have to bend it when i get it, not a big deal. although i heard a yz250 shifter will clear the case without modification.
my next question is: should i re-temper the shifter after its bent (if it is even possible to re-temper)? bending will only weaken the ex shifter. i am pretty harsh on my machine and dont want the shifter to bend from abuse.

Just a question. what purpose does changing it to a direct shifter serve.

the stock shifter has this poorly designed linkage involved in it, the linkage can break at inoppurtune times like on a ride, and then you are stuck in whatever gear you were in when you broke. making it direct to the shiftshaft eliminates all that linkage and the chance of breaking.

Yes, that is the stock shifter. It was cut and the clamp rewelded to it, then I heated it with a torch and bent it in the shape I needed. It hasn't bent at all since. This mod was performed probably 7 years ago. I wouldn't worry about the temper of the steel.
