It could be, since many states do not require titles for many usages however, the smart thing to do is check things out. Do you know the guy? If so that's a plus. Take the VIN # to your local police, they can run it to see if there is any report of theft. If it comes back OK you will probably be fine with it. If you find any inconsistancies - even (especially) if the guy has a convincing story to cover it, run, don't walk, away.

Check the laws of your state and the state of the seller. Some states like where I live no title is required. Bought mine new and don't have a title because I don't need one. Here we register with the state, are issued numbers that are to be affixed to the machine. As long as we are insured we can ride legally on the county roads also.

about a month ago i bought a 01 400EX. the guy bought it in new york, and lives in pa. he didnt have a title. he tried to fead me some bull and said the bill of sale was good enough. so i checked with a friend that works at a dealorship. he told me that if you buy ANY quad it MUST be titled. so i told the guy about it and he was more than willing to get a title for it. just make sure you get a transferable title...
