I recently sold a quad(90cc adly) out of my private garage. I am not a dealer of any sort. I listed it on a yard sale website in as is condition and listed the problems it has. The dude who was interested in it came to look at it. He checked it over and handed me the money ($80). The tires were worth more than that, but I just needed it out of my way. About a week later he messages me saying I'm gonna pay him back or he's taking me to court. He's having buyers remorse and bit off more than he can chew, obviously. I was straight up and honest about every aspect of that quad, and he took it off my hands. My question is does he have a leg to stand on when it comes to taking me to court over this?

 

80 bucks and the guy's complaining... He's bluffing or half nuts or both..Even if he could get a lawyer to take it, legal fees would eat him up alive and he'd still lose.. Private sales almost everywhere are as is no warranty expressed or implied unless noted.

 

I'd say no. buyer beware...as-is.. 80 bucks. He would be laughed out of any court.
At this point in my life (59) I prolly bought bad decision stuff to the tune of thousands.
Tell him about me and explain that he's starting his thousands with your $80.

No attorney will touch that case, worse case is he tries small claims court but the judge will ask for his warranty and when he has none then he is done. If he keeps bothering you you can always countersue for harrasement! And you will have a case!!

 

Wife probably didn't like him buying it, that's probably the real issue here. Probably didn't get her permission to spend the money. She probably told him take that thing back and get your money back. You practically gave it away, he has zero case even if it didn't even run when you sold it.

 

Tell him to pound sand and that if he attempts to go on your property, you will call the authorities on him for trespassing.


$80, sorry but that guy is an idiot! Maybe he should seek out Judge Judy

 

I'd just give him his money back and be done with it. He's wrong but it's not worth the hassle.

Is it titled in your name, and did he get a receipt when he bought it?

If he persists and doesn't have a receipt and it's in your name, you could always say you'll report it as stolen.
