Default A question about lawsuits concerning atvs

one thing i hate about our society: people can sue for almost anything and win 97% of the time and get any amount of money they want, i sometimes want to take a rusty axe and slam it into their face so they cant sue anybody

If one of my friends was ridding on my property and got hurt and sued me....... Before that even made it to courtl I would go over their house and jump off their roof and file a counter law suit. stick that in your pipe and smoke it. lol

sorry oldturtle, under most circumstances, maybe that is the case, but even my wife agrees. The land was originally supposed to be deeded to my wife and the her 3 cousins. Her grandfather owned it, and everyone knows that is what he wants. but he went ahead and trasferred ownership to my wifes dad and her aunt. They will decide when the land gets deeded, even though everyone knows it will be. So essentially we are living not on his land, but land that will be hers, and maybe should already be, but he is scared we will sell the land, so he won't deed it. It has been a major hassle since we moved here, and had we known then what we know now, we would have never moved in the first place. just thought I would clear that up so it doesn't look like i'm too much of an ungrateful son-in-law. this man is just honestly a racist-backwoods-paranoid-redneck a-hole, and has been much of his life.

and that is also helpful about the insurance, I may look into that, see how much it costs. thanks!

while hold-harmless agreements or waivers may be unenforceable in the case of a serious injury, they do get upheld in minor-moderate injury claims. like nedflanders said (man, he's a genius), bad injuries= bad law. so, if your father-in-law is a bit on the unsophisticated side, he may read the waivers and agree it's okay. AND, the odds of a bad accident are so stacked against ever happening, that you could get back to the reality of using land for the fun it was intended for.

don't forget, everyday you drive your car, your 100X's more at risk to cause a financially devasting (to you) accident/injury to someone else. or if you lend your car, you're vicariously liable for the actions of the person you lend car to. SO, do you no longer drive ? HE!! NO! so enjoy the dam property and get buddies to sign waivers for Mr. A$$hole.

Thanks for clearing that up for me. Sorry for jumping to conclusions.
Our motorcycle club puts on two big dirt rides every year. We have event insurance provided by American Motorcycle Association. When someone gets seriously injured it is usually not the injured that sues AMA but the survivors. So even if your friends would have no intention of sueing it could be instigated by your friends relatives. Good luck with a very difficult situation.

True story.
Fellow co-worker ask if ok to hunt on land,
Tries to jump ditch
breaks ankle

turns into his insurance when he arrives at hospital.
his insurance ask for how and where it happened
yep, the good ol land owners, insurance payed!!!!!!

DR. Bill, emerg room visit, surgery for pins in ankle. 3 months lost wages, and the freaking "freind" even tried for partial disability!!!!!!!!!!!!!!!
because he could no longer do his stand up job! He did not get the disability, but the fact he tried was just shamefull.

DyNesh,

I guess I'll put my 2 cents in too.......... I would respect his wishes for now and look for somewhere else to ride with your buddies. Work on getting that land in you and your wifes name. Don't cause any trouble that might keep you from achieving your goal (riding land). I know it sucks, but be patient, it will pay off. I'm in a similiar situation and anytime time family is involved in these types of money/land deals, things can get ugly quick.
As for lawsuits, I'm not even going to tough that one. I think it has been touched on enough.
