Default 13-yr old Boy Killed...

A good friend in high school died from this same type of gate. This one was hid on a trail that was rode on alot. Hopefully whoever is responcible for this accident will be held responcible.

Number " 1 " ... the kid was only 13 ! Number "2" you death to all teenager trespassers mental midgets .... he probably did'nt see the NO TRESPASSING sign that WAS'NT put on the cable ! I don't know about that state but here the landowner would be selling or mortgaging his land to pay the law suit he would most surely be getting . If it's not legally posted by state posting requirements ... it's open road or lane . If you have the money to buy and mount a cable ... almost INVISIBLE until you hit it ... you can buy 2 or 3 no trespassing signs at a buck and a half at Walmart ! I can't believe anyone would say a 13 year old boy deserved to die that way for riding down a country lane ! Remember " what goes around === comes around " I'm sure there's teenagers in your family . As you read the report .... "was'nt able to stop before hitting cable " that landowner should be glad ... and anyone with those remarks also ... that was'nt my son ! He'd be looking over his shoulder for many years awaiting my visit that would surely come .... and it would'nt be a pretty or a joyous ocassion !

I have read most all of these posts on this subject. The number one thing I have yet to read is WHERE WAS THE ADULT OR PARENT!

Should a land owner have to mark his cable with what ever, hmm kinda up to him. What about ranchers with barb wire fences, no one on here seems to be saying where are the flags on those wires.

Anytime someone is killed and a lawsuite is brought up, no matter if they were sapose to be there or not they will win. It's not fair, but we the people have sat in court rooms and made the landowner pay.

So when this happens to you, sue the parents if they weren't riding with them. These machines no matter on the size are not babysitters!

First of all to the family; our deepest simpethy... There is the unfortunate loss of a young life. There is no reason or absolute cause. There is a family missing a son.... Although some would want you to believe with proper governmental controls we can avoid these unfortunate accidents, it's still humans living and enjoying life.. And yes accidents do happen. With everyone below me trying to find a blame or cause; whats wrong with just saying "We are sad for your loss"...

I am a landowner as well. I also saw that this started out as an account of a tragic accident and you began conclusion jumping. I had a friend run into a fence on our spread because his throttle hung up, not because he couldn't read at 50 mph, or he was retarded, or he was irresponsible. His throttle stuck. It was just that simple. Lucky for him he was tougher than the nails holding the boards to the posts.

Well as much as I feel for his parents, there is a lot we do not know about the subject, where were his supervisors?, How fast was he going?, Did he have permission?, In arkansas you are required by law to have no tresspassing signs up, or have purple paint on trees or signs(posting paint) to warn people about no tresspassing. When I was little we never went on other peoples property without permission, we knew where we were supossed to ride and where not to ride

Hello, I'm a owner of a parcel of land. I have read a few of these posts and this may have come up already. Forgetting issues like why was the 13 year old riding alone etc....I find that one gut feeling truth in this is that as an adult who owns property one has the responsibility to assume certian possibilities. Within reason, of course not all things can be your fault but I have to say that if I put up a neck slicing barrier on a pathway I know that in my heart it's probably pretty stupid....doesn't matter what else, it just feels like I'm asking for trouble. Afterall the hardly isn't a single year that goes by around here that I don't hear on of these stories. Therefore as a responsible adult I have to say that anyone who puts this kind of obvious risk is truly using poor form. There are ways we can act like adults and as adults we have to make a reasonable effort to assume the possibilities and like I said, this happens every year. Gut feeling on this particular arguement, even as a landowner myself, with kids tresspassing to smoke pot on my property and dump garbage....these things I have little control over but setting up potential disaster is one thing that I do have control over.
