Perfect example of out of control government......and lack of common sense, but then again what do you expect from the great state of California.

I did more reading about this and it really is not so much a government out of control as it is a classic example of how the US is so lawsuit driven. This is just an grander example of the ambulance chasing attorney.

It seems the way it works is these environ groups are able to find technical violations in the laws governing such matters such as this; waivers were supposed to be obtained from water quality board to abate "pollution" in creek.

What makes this work is they make the case to attorneys who pick up the case to get a big payday if they prevail and since the judge needs to follow the law and support violations, they get the big payday.

Then they get more money to fund the next lawsuit. It is a vicious circle and not one likely to change any time soon.

I looked at the complete filing and it was not trivial. I thought how could some no-name enviro-**** group get so much money to fund such an effort. It is a BIG deal, look at the whole filing. Anyway, I then discovered they do it since they get the big paycheck.

This just is another example of how the United States is so entangled in legal problems every step you take, no matter who or what you are doing.

I love the line:

"We have nothing against off-roading. We have nothing against the concept of off-road parks. They've just got to comply with the same regulations as everybody else,"

sounds so nice..

Im going to be at Carnegie tomorrow for most of the day.. been riding there since 1974 when it was a privately owned park. Taking a few dirt bikes and the Jetmoto 250..

Spent about 5 hrs at Carnegie today... So crowded you would think it was a weekend... Lots of people fired up about the closure..

Heres the weird part... There is NO WATER flowing in the creek at all. What will they be testing to open back up?

The battle continues another day. The appeal was filed late last week and was accepted so the park remains open until the next court event mid January.

Glad you got out there. It made a difference!

Carnegie wins and stays open. In fact, I think many other folks in ag and ranching got all shook up about something so stupid and were worried they could be next.
