It just went out here for about 2 minutes. Took 5 minutes for Tivo to warm back up.

CLOUT Legislative Alert: Congratulations!


Give yourselves a big round of applause! You have done the impossible this
year! Those of you receiving CLOUT alerts got those committee members to
hear you loud and clear!

We all also owe a big THANK YOU to Tod Petersen and John Eaton (NMA/WOHVA)
who took the time out of their busy schedules to show up at the hearings and
testify against these Bills. As you know, WA State OHV efforts are a 100%
volunteer effort with no paid staff. The CLOUT system is a vital part of
that all volunteer effort.

The Chair of the Senate Natural Resources, Ocean & Recreation committee,
Senator Ken Jacobsen (Sierra Club and WTA supporter) was unable to get his
three personal Bills (SB 5128, SB 5761 & SB 5586) regarding OHVs out of his
own committee this year! That is almost unheard of!

As you may know, the Chair of any committee can effectively stop any and all
legislation going through that committee that is sponsored by any other
member of that committee if they do not support his legislation, i.e. the
Chair has the power to pocket veto everyone else's legislation unless they
vote for his.

Senator Ken Jacobsen was really on a crusade to impede/inhibit/destroy OHV
recreation during this year's legislative session. His personal vendetta
against the family sport of OHV recreation included the following;

SB 5128 (Current Status = DEAD): Sponsored by Jacobsen & Kline. Addressing
natural resource impacts from off-road vehicles.
Would have allowed state agencies to take our ORV tab and gas tax refunds to
repair damage caused by "off road vehicles" even if that land management
agency did not allow any ORV use on the land they manage. Kind of like
taxing sober drivers to pay restitution to the victims of drunken drivers!
If it is appropriate to send someone to jail for damaging a vegetable with
an off road vehicle, why wouldn't doing the same harm with an automobile,
horse hoof or shoe be just as heinous a crime and be punished equally
severely? Their bias against OHV use was obvious.



SB 5761 (Current Status = DEAD): Sponsored by Jacobsen. Creating a
recreation pass for use of DNR lands
This Bill was opposed because it once again discriminated against OHV users
by providing an exclusion from the new Pass requirements for ORV tag
holders. OHV users are the only user group that already pays to play on DNR
land and has done so for over 37 years now. We also needed much tighter
constraints on how the funds generated by the Pass and existing ORV tag
purchases would be used and accounted for.

The DNR has done an abysmal job of accounting for the nearly $30 million
dollars they have already received by taking nearly 40% of the Nonhighway
and Offroad Vehicles Activities funds right off the top. They have never
been able to show in detail what they have done with that money to benefit
Off Road Vehicle (ORV) users after many, many requests for that information.
It is way past time to hold them accountable for what they do with our
money. As of today, we do not have a single mile of new OHV trail on the
ground in the Ahtanum or Reiter areas to show for the almost $900,000 of our
ORV tag funds the legislature gave to the DNR in 2008!



SB 5586 (Current Status = DEAD): Sponsored by Jacobsen. Mandatory ORV rider
licensing - WA State off-road vehicle safety education and training program.
The real objective of this legislation was to divert the paltry amount of
OHV funds into funding more bureaucracy so those funds could not be used on
the ground to actually benefit the users the way they intended when they
voluntarily taxed themselves to set up the WA State OHV fund.
Senator Jacobsen's backers (Sierra Club & WTA) should be suggesting that
they require training and licensing of hikers and mountain climbers if they
are really serious about improving safety for people who recreate in the
outdoors.
We do not need to experience the huge expense and added bureaucracy that
Oregon is currently going through, gobbling up millions of dollars from
their ORV funds with very little actual benefit to the users. The Oregon
legislation even requires out of state users to take the training before
riding in Oregon!
The WA motor sports dealers believe that ANY legislation that puts up more
hurdles for their customers means less business and in these times that
could (and probably would) be the last straw for many dealers in WA.


One Caution; It is never over in Olympia until they adjourn the session.
Many sneaky things can be tried even after Bills are dead. Remain vigilant
and prepared for futher action if needed!
