Here's a picture of the water/gear lube sludge leaking out of my 84 mile almost new rear end after removing the seal

Nice pics, that would be great if the Yamaha parts fit right in there. Where do think the water came from? Riding it and it leaked in or was it in there from sitting on some boat or something for a couple years??

Hey also in that swing arm housing , did they use bearings with a seal on the end or did they cheap out and use bushings or something? The pivot point where hooks up to the frame.

I am assuming that the boot had a slight crack in it right from the beginning and everytime I went through water or some mud it was making it's way to the seal which eventually get enough dirt and water in it to cause it to leak and take in more water. The rubber they use to make the boot is very cheap. I was able to make it crack in areas just messing with it in my hands. The swing arm housing has bushings that kind of look like a giant magnetic oil drain plug on each side. They thread into each side using an alan head wrench then a lock nut goes over them to secure them in. I'm going to head to the dealer in a bit and order up these parts. Pray they are the same..

I finally got an email response back from Tank-Sports full of excuses. I don't think there is an possible excuse for not sending parts in a 3+ week time frame. I am so sick of this.

All this email basically tells me is they look at emails daily when they need to sell something or collect money but other than that you will be waiting around for a response until they feel like looking at it.

Second they are telling me that in the past month buildings have burned down, no internet, packages lost, no tracking ect...... (the world is coming to an end in California???)

Third, I am screwed repairing the defective bike at my cost and for all we know it could of been a defective bike that was returned to them or one that did not pass inspection and I'm the lucky guy that bought it. (which would be the reason why they auctioned it)

Last is a good one actually if they ever come through for me. They seem to be willing to replace anything I need replaced that is defective or broke but then again...Will I ever recieve the parts???

All this kind of made me laugh at this point but I guess it's all a learning experience for myself and everyone else that reads this review!!

Good morning Mark, sorry to see that you are still having issue with the quad. Dona is the master tech here, hes pretty hard to get a hold of, even for me. He might have overlooked the email that you sent him. But please note that we always try our best to fulfill our commitment and to the best of our ability to satisfy customers.

I see that you have already filed a dispute on paypal and left a negative feedback on ebay. I am sorry that you are at this tough situation. It is very unfortunate that the thanks giving weekend along with the blaze that took out the telephone box have caused so much issues. Remember I told you we had UPS pickup the parts box, but because there was no internet we could not upload or get tracking #s? well because we couldn't upload or get tracking numbers that entire 2 day worth of packages that we sent out are lost. your package isn't the only one. we have dealers that purchased 20 vehicles wanting their package but the situation does not discriminate.

the package was returned back to our facility as of today after a round trip to san bernadino sorting facility.

so lets come back to the subject on hand. as according to Don's reply, he wanted you to adjust the clutch, you asked for directions but he has not replied. This I will speak to don about tomorrow morning first thing.

Second your package will once again be shipped, and this time we will have a tracking number tomorrow.

Third we have already issued a partial refund on paypal. As you might have already read and reread, the ebay auction terms are very clear, no cool downs and as is with defective parts only warranty. Therefor, I am unable to honor any labor warranty or claims, straight parts only.

since we will be sending out the package tomorrow roughly around 4pm. please let me know if there is anything else you want don to claim as warranty before we mail the package out, do not worry if you don't get it don tomorrow. we have more time later on as well.

The 400U is a great bike, comparing to other 400CC class vehicles from China its very well made. As your friend in the dealership might have even noticed, the 400U is almost a direct clone of the Yamaha (grizzly i believe it is). Jianshe of China is actually a joint venture of Yamaha. We indeed have sold many and many units. Very rarely does it come down with as much issues as you are experiencing. I am deeply sorry about that. But please let me know if the clutch needed to be replaced. get me photos of it asap so I can pass it along to Dona our tech.

Please CC me on your emails if you would like to email don directly, so I can also remind him of the emails.

Jim

Your thread here is a great product review, I'm sure the company and 100's of other ATVers are following this. This form on ATV Connections does get a lot of hits.

So now you have to wait to see if they send you all those parts you ordered at the start. As for the parts to put it back together I'd go with the Yamaha ones as it sounds like they are not too expensive and at least you know they are good quality.

First, I am very sorry to hear your story but it is not unusual for anyone buying a Chinese moto. The good news is most of us have experienced that once you get all the initial problems sorted out the thing will run without much serious problems. I have a hard time remembering if a transmission or engine outright failed. All sorts of bits break off here and there, chains stretch, sprockets wear out, carbs get funny, gas shutoff valves leak, batteries die, rubber bushings go out, etc.

It will never run as hands-off as a big brand, it is just not made of the same quality components, so plan to have the toolbox at the ready but most likely doing small jobs.

As to the legal title issue, you should receive a certificate of origin, maybe another document that enables one to get a legal title. At least that is how I remember in California and I'm sure other states will not require more of you.

What I would do is encourage them to work with you to your satisfaction, otherwise you will contact California motor vehicle agencies and file a complaint. I am sure this will help get some response. They do NOT want to lose their California vehicle distributor license.

Following is some specific info you can use.

Documents needed to register an OHV that has never been registered in California

If you purchase a new or used OHV from a California licensed dealer, the dealer will collect the fees due from you and provide the department with these fees and documents to transfer or register the OHV for you.
If you purchased an OHV that has never been registered in California from anyone other than a California dealer, you will need:
  • An Application for Title or Registration (REG 343).
  • A vehicle verification by an authorized DMV employee or law enforcement officer, vehicle verifier, or authorized auto club employee.
  • Evidence of ownership, which may be:
    • The Manufacturer’s Certification of Origin endorsed to the nonlicensed dealer and any bills of sale needed to establish a complete chain of ownership to you.
    • An original or certified copy of the factory invoice to the nonlicensed dealer and any bills of sale needed to establish a complete chain of ownership to you.
    • Out-of-state titling documents and any bills of sale needed to establish a complete chain of ownership to you.
  • OHV fees and use tax, if due.
The Department of Motor Vehicles collects OHV licensing fees and maintains registration records pursuant to Vehicle Code §38010.

I am sure they have legal requirements to send you the proper papers, irrespective if the sale was out of state. If they have not done this according to the vehicle code, they you have something against them to report unless you get your issues resolved.

You have too much at stake and I feel your anxiety and frustration. I am sure you will get their attention when you get your facts and jargon down and start talking about getting California DMV involved. NOBODY who is sane wants anything more than the least involvement by them.

One last thing I just noticed is they just moved to a new location October 2009. If they mentioned they are a bit unorganized it could be legitimate.

They seem to be up and up and current with the Secretary of State.
At least they are not a fly by night group, have been around a long time, so that gives you big hope things will get resolved. It would be quite different if you got totally ripped of by some con artists which these folks clearly are not.

One last reference. Turns out they are a public company on BB or penny stock exchange. They do not have very rigid reporting requirements like companies on major exchanges but at least they have to be someone legit. One of the very few Chinese ATV importers who are of such a status.

Thanks Windtrader that's alot of great info about Tank-Sports. I don't doubt they are a legit established company. I am just really unhappy the way they are handling this whole ordeal. Not that I would put the chinese seals and boot even back on the atv, it was the fact that they could make the effort to get them to me asap along with the other parts nessasary to repair the issues previously reported. I hate when people make excuses for thier mistakes or problems. I am sure the company didn't shut down because a phone box burned down and lost track of dealers orders (20 atv's) They would have to be complete idiots to allow an order of 20 atv's to leave without tracking info nevermind a shipment like mine full of replacement parts. Even if they did have this issue, this accounts for 2 days out of the 24 days they have been aware of the issues. I'll give them the benefit of the doubt and allow til the end of the day for tracking info them make a call to the California Motor Vehicle Department. Thanks again for the help!

Mark

I may keep it. I haven't decided yet. I'd like to get it all together like it is supposed to be and giv eit another shot. I think it's going to feel like a new machine since I adjusted the clutch. Just from riding it down the street I felt a very noticable difference. I am going to pull the carb off, clean it, re-install it and re-. adjust the idle/air/fuel mix. I'd like to hang onto it being a 4x4 but not sure if I can deal with the lack of power the atv had. The atv didn't do too well in the mud or sand where some of the guys I was riding with would go right through the stuff. If that becomes the case again I will sell it
