Today I ended up getting a call back from the Investigations dept in El Monte CA. They faxed me the nesassay info I needed to enter a complaint and directed me to the proper site to print the compaint procedure and forms out. I just mailed it off with copies of my emails between Tank Sports and myself. I also sent all the pictures I had and typed out a description of what has been going on. The other thing I pointed out was the specs on the Tank Sports website vary from the actual specs on the title I recieved.

A 2007 was advertised in the auction and I recieved a 2008
(not that that bothers me)
I probably won't hear back from the DMV for a while but i'll be sure to update when I do

Thanks for keeping us updated lowbudget..i gotta admit Im real glad I didnt get a Tank.. I live close enough to drive there and make a fool out of myself.. (or atleast make the nightly news)
jianshe400 , Id pay the shop to remove the clutch (unless you want us to talk you thru it) I be real shocked if the Yamaha parts dont fit..

@lowbudget - don't be so negative. got a call back in ONE day from DMV, pretty darn good. Just remember offices are closed 3 of 4 Fridays of month due to furloughs. When you talk to them tell them you feel their pain and how overworked they must be but sure thankful they are able to help you out. Yes kiss some ***!
Now that you are going this route, get ALL discrepancies detailed and documented. Things like selling a 2007 as a 2008 is a BIG deal. VIN numbers not matching, engine sizes not matching, all that stuff is going to cook them. You go dude! RAH! RAH! RAH!

I guess if your clutch is screwed you don't have a lot of options to get it running. It scares me you are going to put probably $250 to just get the clutch fixed. We have mentioned to everyone everytime about running away like mad from these chinese quads unless you are good with a wrench and LIKE to use it. Something else is going to break real soon after you get it back, it is the nature of these things. You should seriously think of unloading the thing, maybe even in its current state, adjust price for bad clutch. It will eat you alive for sure.

Yes it sucks if you can't do work youself when you own a Chinese ATV.

You may have sent it all. I guess I am suggesting to make it REAL easy for them. Check with your attorney to identify any/all major discrepancies that they can go after and put those in a separate communication clearly stating these specific points.
It will likely make it easier for them to follow up. Just making it easier to do something now rather than throw it in the pending file. Keep up the good fight.

Great! Sounds like you are 100% out of the gate, hope for the best now. You have been really focused on chasing this down and seems like you have done all one can possibly do. Having an attorney get involved so early will also put lots of folks on notice to be persuaded to do the right thing.
California also has many extra consumer protections including lemon laws and mail-order sales, warranty, etc. The lemon law typically is a car thing but I know it applies to electronics. Goes something like it breaks x amount of times in x period, you get some sort of relief. Maybe ATV falls into some applicable category.

Today in CT we got about 8 inches of snow in my area so I decided to take the atv out for a cruise. I installed the new rubber boot and seals so the rear end is all set. I did about 45 miles today around town since nobody was really on the roads all morning. I went out with a buddy with a 2007 Honda Rancher 420cc 4x4. The atv kept up alot better with the clutch adjustment and a little carbuerator tuning. I still need to tune it a bit better I think though because at full throttle the atv cuts out occasionally and I have to pump that last 1/8 of throttle to get it to clear out and run full throttle. I am pretty sure I just need to richen it out. Today I saw about 45 mph in 5th gear and ran about 55 mph down a few hills. Not too bad I guess. I was able to hang pretty well with the 2007 Honda Rancher but... probably because he rode with a plow on the front of his atv. The Honda Rancher still has more power than the Jianshe will ever have and gets up to speed much faster and smoother. Some more carb tuning and I may be half way satisfied with this atv(((Note: I said ATV not Tank-Sports))). I am finally happy to say I actually had a good time today and was glad to be riding again.
