Sounds like a fun snowy ride LB! Forgive my ignorance here. I'm trying to piece together this mammoth thread! What are you trying to accomplish with the legal action and DMV stuff associated with your ATV if your still tinkering with it, riding it, etc??

I had to get it back together being that I had to completely disassemble the rear of the atv to find out what was leaking and to replace the rubber boot. I ordered the correct parts to fix it from Yamaha because I have been waiting for weeks and weeks for replacement parts from Tank-Sports but still nothing except for more broken lenses and a damaged control switch assembly. I repaired the leaking rear end mainly because there is no gaurantee that Motor Vehicle or Lawyer will be able to do anything for me. By filing a complaint with motor vehicle and getting a lawyer involved I am trying to hold Tank Sports accountable for sending me a defective/damaged atv. I may of fixed the rear end but had to buy the parts myself. Tank-Sports 1 Year Warranty and Customer service is worth nothing to me. You cannot go around distributing/selling motorcycles if you are not going to stand behind your product. I still have 4 signal lenses that are damaged, a cylinder head with a broken heat sink, broken headlamp controls and have not recieved any parts that I had to purchase to repair the rear end issue. Would you buy from a dealer that treats customers this way?

No I sure wouldn't! I'm not questioning that at all. That's a horrible situation and I feel for you. What I am questioning is; If your goal is to return this ATV for a refund, or get your money back in some way, you may want to clean it up spotless and park it. I wouldn't think doing your own repairs and using it would help that cause at all.

The fact is that the atv is not brand new anymore but only a little less than 2 months old. I kept my emails as evidence of the exact dates of each problem. Some problems occuring the 1rst day I recieved it and to this day still not corrected by Tank Sports. This has been going on for almost 2 months now. If I get a refund I get a refund but I'm not going to just store this thing for months even possibly a year while this is sorted out. Nothing through DMV goes smoothly and quickly. I'm a licensed CT repairer so I have documented the repair costs and labor for my records if repairing it becomes an issue with DMV or Tank Sports. The other thing is, I wouldn't have known about the mechanical issues if I hadn't of used the atv. (rear end leak, clutch slipping, carbuerator problems, broken leaking lenses). If I get stuck with it which is a big possiblilty I would like to report any other issues that occur as soon as possible being that I have a "1 year warranty". Not that they have stood behind their warranty at all up til this point..

I hear ya. Given the circumstances, you might as well use it. Maybe you will recoup some money based on your documentation or get some freebies out of it (new machine)?

Simple replacement parts as promised would have resolved this whole issue but since Tank Sports wants to play games with me... Yes a new atv would be nice or my money back. After waiting over a month for parts and recieving 1/2 of them of which were mostly broken, that was just another slap in the face from Tank Sports. Now I am just mad and very annoyed

Update from EBAY. They are of no help I found out besides sending me a link to the vehicle protection program. I just filed a complaint with them also so I guess we will see what the outcome is and if they can help. Merry Xmas to everone out there and I will update again soon!

Below is a link to the pictures and a link to the control switch not working properly. All pictures in the link below have a decription attched so you know exactly what the issue is. After a month after reporting the issues the seller sends me a box of broken parts and missing the majority of the promised parts. If emails are needed I haveemails between the seller and I dating back to the 16th of November whenI started reporting the issues. Please take the time to review the 3rd link I attached. The link included copies of email/pictures and important info that you may use to make a decision in resolving the problem. I wanted to make others aware of what I have went through. I came across a link to the California Lemon Law. If you lived in California it would apply for sure. I looked but did not find any reference on how it applies to out of state purchasers. It put the emphasis on the seller side, that they sold the lemon in California. There is some good info and contact info.

At least you have one more government agency you might be on your side in this battle. Keep up the good fight and sorry about eBay not helping much.

You are helping others by your posts and we try to help you too. What is becoming clear is how flimsy the protections touted by eBay, PayPal, etc. when it comes down to trying to resolve something significant.

They do have limited utility though. My eBay account info was sniffed over an open wifi link and used to buy a pack of 20 games in Europe somewhere. Their automated fraud detection system flagged it and sent me an email informing of such purchase. I immediately reported it as an unauthorized transaction and they did promptly resolve it but that is sounding like the extent of their protections.

If the transaction was valid and the dispute is about the goods or services, condition, warranty, refund, anything like that, it seems like they wash their hands.

Keep up the good fight!

The Honda Rancher still has more power than the Jianshe will ever have and gets up to speed much faster and smoother. Some more carb tuning and I may be half way satisfied with this atv(((Note: I said ATV not Tank-Sports))). I am finally happy to say I actually had a good time today and was glad to be riding again.
Good to hear you at least got to ride it some more. Also cool that it gets around OK. You gonna keep it?
