I checked with Yamaha friday and the the parts weren't in as of then. They told me to check back monday. He sounded pretty positive they would be in by then. They told me 5-7 days which sucks but what other choice to I have. I've been waiting weeks... I checked the tracking # from Tank-Sports and ups shows the box on time and the arrival date as wednesday the 16th.

Cool. sounds like you can be offroading again next weekend. Also seems like you decided to deal with what you have rather than try to return to Tank. I saw the Paypal response but you could still pursue. However, I can understand what a pain and lot of effort it would take and probably not worth it in the end. Like you say, give it go and if it still sucks next year, unload and do something else.
REALLY sorry to hear about CT - no off roading. I guess it is a rather small state and very old state so all the land got allocated a long time ago.
We are lucky out here since there are huge blocks of land that are National Forests and BLM (Bureau of Land Management). I believe BLM land is still almost nearly wide open except for some designated special zones. National forests are implementing a forest inventory project which is shutting off lots of access but to be fair there is still huge amount of trails, especially compared with you back East.
And MWQ is just a cheap ***, trying to get a free ride off everyone else. Although I do wonder how you are riding in State OHV parks without current tags? Inquiring minds want to know.

Isn't Tank out of business? Along with thier division ATVPartsUSA.com? If true I wouldn't hold much expectation or recourse from a bankrupt enterprise.

I will keep the atv for the time being. Probably give it another shot with the clutch adjusted and see how it goes. To return this thing it would take months to settle with them if not longer or at all. I am just glad I didn't spend the $4k+ on one of these. For the $2600 i'll be into it for I think I should have no problem getting that back on craigslist as long as they don't read this....lol

For all I know they could be going out of business. Everytime I seem to call I get a full voice mail box. There has been 2 times I actually was able to speak with someone but was transfered over to these voice mail boxes....hmmmm kind of like their full email addresses that cannot except mail

Exactly. ~$2600 is no chump change, but you'd probably go above and beyond that with legal fees and frustration. I bet a little more tinkering and you'll have it tip-top. Like you say, you'd definitely be able to recoup most of the $ on CL if you wanted to.

I have a parts update. My parts from Tanks Sports have still not arrived but I did get the rear end parts I ordered from Yamaha today. The parts are identical except the chinese quality is horrible compared to the Japanese. The rear differential housing and components are identical but anything made of plasic or rubber is duplicated and not in a good way. The rubber is cheap, half the thickness and flimsy compared to the japanese yamaha rubber boot. The Yamaha boot is probably twice as heavy as the Jianshe one. Here are some pictures comparing each part.

I have come to the conclusion that Jianshe/Tank Sports 400U atv's may be a close duplicate of the 2000-2006 Yamaha Big Bear 400 4x4 but fall way behind when it comes to quality control and build quality. For the price I paid I really can't do anything but deal with the issues as they come. The one nice thing is I can buy these parts at a local Yamaha dealer. I bought an oil filter also and it is identical to the yamaha one. I wouldn't recommend this atv for someone who doesn't know how to turn a wrench because most likely you will be doing plenty of wrenching while owning a Jianshe. I guess we'll see how everything goes in the next month or so. I should be able to get the atv out this weekend and will keep everyone updated. I will also let you all know if I recieve the parts from Tank-Sports on wednesday. I want to thank everyone for their help throughout this also
